MOTION 5: LIMITS ON RE-ELECTION AND THE CONFIRMING OF BALLOTS - RULES 9.3, 9.4 and 10.5

Original rule 9.3:

9.3 Eligibility to stand for election

Retiring officers will be eligible for reelection, except that the president and vice president may normally hold office for not more than [5] successive years in any one capacity.

A member may not normally be declared elected to more than one officer or ordinary position of committee membership.

Proposed changes to rule 9.3

In 9.3 Eligibility to stand for election, replace first paragraph with:

Retiring committee members and officers will be eligible for re-election, except that any of the Branch Officers, as defined in 8.1, may hold office for not more than [5] successive years in any one capacity.

Rationale: To clarify that ordinary Committee members can also be re-elected. To extend the limit of office (currently 5 years) to all the Branch Officer roles, thus increasing democracy and accountability.

Original rule 9.4:

9.4 Elections

Subject to rule 10.4, if there is only one eligible candidate for any officer vacancy that candidate will be declared elected.

If the number of candidates to be ordinary members of the committee does not exceed the number of vacancies those candidates will be declared elected.

If there is either more than one eligible candidate for any officer vacancy or more candidates than there are vacancies of ordinary members of the committee a ballot of the members of the Branch will be conducted in accordance with rule 10.

Proposed changes to rule 9.4*

In 9.4 Elections, after 2nd short paragraph ending “will be declared elected” insert:

The election of officer(s) and committee members with the above mechanism, will be ratified by a single vote for all posts at the AGM.

Rationale: To make sure the membership elects all ordinary Committee members and Officers by some process, even if the positions are not contested. This is existing practice and the amendment just adds it to the branch rules.

Original rule 10.5:

10.5 The result will be notified in writing by the Returning Officer to the secretary and as soon as practicable by the secretary to the members of the Branch and to the General Secretary of UCU.

Proposed changes to rule 10.5

In 10.5 replace “secretary” in “The result will be notified in writing by the Returning Officer to the secretary” with Branch Officers

Rationale: To ensure that the election results are promptly communicated to the Officers and the membership.

Result: Carried (76% in favour; 18% against; 9% abstentions)*

* Theamendment to rule 9.4 was not accepted by UCU Head of Constitutional Affairs, and so will not go into our rules.
